Webinar: Ethics in MSP Compliance

Medicare Secondary Payer (MSP) compliance is a dynamic area where many different elements intersect, including claims and risk management, medical and health issues, legal and privacy considerations, the court system and government agencies. There are also numerous professionals with overlapping roles, including nurses, attorneys, claims adjusters, professional administrators and structured settlement brokers. Not to mention that we operate in an area of the law that is constantly changing and subject to wide interpretation. As a result, MSP practitioners are bound to face ethical issues and dilemmas. The presenters will explore various ethical principles, considerations, situations and practical approaches.

Shawn Deane, JD, CMSP
General Counsel, Ametros Financial

Shawn Deane is General Counsel and leads the legal team at Ametros. He has over a decade of experience practicing law and in Medicare Secondary Payer (MSP) compliance as an industry thought leader. He was previously Vice President of Medicare Compliance & Policy at ISO Claims Partners. Prior to that he practiced insurance defense litigation and healthcare law.

He has been heavily involved with The National MSP Network (MSPN), having served as chair of the webinar and education committees, on the Board of Directors, and was President in 2017. He was also former executive committee member with the Medicare Advocacy Recovery Coalition (MARC). Deane is faculty for the Certified Medicare Secondary Payer Professional Program (CMSP).

Jennifer Shymanski, JD, CMSP-F
Vice President of Implementation and Strategy, NuQuest

Jennifer Shymanski, JD, CMSP-F is the Vice President of Implementation and Strategy for NuQuest. Using her eleven years of experience working at a large national carrier and ten years of experience in Medicare Secondary Payer compliance, her focus is on assisting clients in designing and then implementing their MSP compliance programs. As part of the NuQuest Settlement Consultant Team, Shymanski uses that claims and MSP experience to assist clients in reaching optimal outcomes for their claim resolutions. Jennifer also develops the training content and creates the educational programs at NuQuest.

Shymanski is the co-chair of The National MSP Network’s Webinar Committee and a member of the Communications Committee. She is also an instructor for the Certified Medicare Secondary Payer (CMSP) and CMSP-Fellow designations. And is an adjunct instructor of Business Law at Northcentral Technical College in Wausau, Wisconsin.

Tom Spratt, CMSP-F
Independent MSP Consultant

After a long career in Casualty insurance handling Workers' Compensation and Liability matters, Tom Spratt has been actively involved in Medicare Secondary Payer compliance since 1999 when he developed a ground-breaking Medicare Secondary Payer compliance program for a national carrier. He has spoken on this subject at national insurance industry conferences as well as training sessions for clients.

He has a long record of active involvement in the insurance industry, serving on committees for the Workers' Compensation Research Institute/WCRI, the Property Casualty Insurers Association of America/PCIAA and the Strategic Services on Unemployment and Workers' Compensation/UWC. He also served on committees for the National Structured Settlement Trade Association/NSSTA and the National Alliance of Medicare Set-Aside Professionals/NAMSAP as well as the NAMSAP Board of Directors.

He is on the faculty of the CMSP (Certified Medicare Secondary Payer designation program), which is the only program where both the law and allocations make up the curriculum.

He currently is an Independent Consultant with a special focus on Apportioned MSP Allocations in Liability matters in the settlement process.
