MSPN Statement of Ethics and Professional Responsibility |
Preamble and ApplicabilityThis Statement of Ethics and Professional Responsibility has been adopted by the Board of Directors and Membership of The National MSP Network (MSPN) to provide guiding principles to its members and member organizations. Implicit in the acceptance of this Statement is an obligation to act in a professionally responsible and ethical manner when providing Medicare Set-Aside consultations.This Statement applies to all MSPN members and member companies, regardless of their voting rights and responsibilities. Principle I: IntegrityThe MSPN member shall offer and provide professional services with integrity. The MSPN member must exercise the utmost in integrity when providing Medicare Set-Aside Arrangements. The nature and extent of services rendered must be dictated by professionalism, honesty and candor that should not be compromised for personal gain or advantage. The MSPN member must also exercise faithfulness to the obligations and duties they have accepted on behalf of their client as well as any obligation to others involved in the Medicare Set-Aside (MSA) process.Principle II: CompetenceThe MSPN member shall acquire and maintain the necessary knowledge and skills to assure delivery of high quality professional service. Knowledge and experience are the cornerstones of our industry. All MSPN members are expected to attain and maintain an understanding of relevant provisions of applicable state laws, claim procedures, CMS guidelines, and federal laws related to the Medicare Secondary Payer Statue. The MSPN member shall make a commitment to continuing education and participate in appropriate professional education programs and seminars sponsored by MSPN and other organizations. Furthermore, The MSPN member must recognize when something is beyond their level of expertise and seek appropriate help or guidance.Principle III: Fairness, Honesty and Due CareAll persons engaged in the provision of any part of an MSA shall perform their duties in an honest, ethical and fair manner. Fairness mandates intellectual honesty and is an essential trait of any profession and is best reflected when treating others in a fashion as one would expect to be treated.Principle IV: ConfidentialityAn MSPN member shall not disclose confidential information to unauthorized persons except with specific consent of the source thereof, or in response to applicable federal or state legal requirements or court orders. To promote MSA's and to strengthen MSPN, its members must not reveal information which is confidential without the express consent of the source thereof or pursuant to legal requirements (such as statutory authorization, subpoena, or court order).Principle V: ProfessionalismConduct of MSPN members in all matters shall reflect upon the profession. The important professional services rendered by MSPN members carry the attendant responsibilities for members to behave with dignity and courtesy to all those who benefit from their services, including fellow professionals, those in related professions and clients.Principle VI: ComplianceA MSPN member should comply with all material federal and state laws and regulations. |
