Secondary Payer (MSP) compliance is a dynamic area where many different
elements intersect, including claims and risk management, medical and
health issues, legal and privacy considerations, the court system and
government agencies. There are also numerous professionals with
overlapping roles, including nurses, attorneys, claims adjusters,
professional administrators and structured settlement brokers. Not to
mention that we operate in an area of the law that is constantly
changing and subject to wide interpretation. As a result, MSP
practitioners are bound to face ethical issues and dilemmas. The
presenters will explore various ethical principles, considerations,
situations and practical approaches.

Fran Provenzano, RN, BSN, CDMS, CCM, CLCP, MSCC President MSA Specialists
Fran
Provenzano, BSN, is the President and CEO of Medicare Set-Aside (MSA),
Specialists, Inc. She formed the company in 2002 and it has flourished
under her guidance. MSA Specialists has been accepted as a national
provider of MSAs by several major insurance carriers as well as some of
the top Third Party Administrators.
Provenzano is a highly sought speaker on MSAs. She has addressed the
National Conferences of Legal Nurse Consultants, several national
education seminars on MSA instruction and many evaluation
criteria/education sessions for Claims Adjusters. She earned her RN
license and BSN Degree. Within the hospital setting, she has served in
virtually all phases of the nursing field from the operating theater,
through patient education, Lamaze Instruction and discharge planning.
In the late 1980s, Provenzano directed her talents toward Disability
Management, obtaining her Certified Disabilities Management Specialists
(CDMS). She was among the first nurses to obtain Certified Case Manager
(CCM) Certification followed shortly thereafter by her Life Care
Planning Certification (CLCP). Most recently, she once again was among
the first in the nation to earn the Medicare Set-Aside
Consultant-Certified (MSCC) designation.
Jennifer Shymanski, JD, CMSP-F Vice President, Implementation and Strategy NuQuest Jennifer
Shymanski, JD, CMSP-F is the Vice President of Implementation and
Strategy for NuQuest. Using her eleven years of experience working at a
large national carrier and ten years of experience in Medicare Secondary
Payer compliance, her focus is on assisting clients in designing and
then implementing their MSP compliance programs. As part of the NuQuest
Settlement Consultant Team, Shymanski uses that claims and MSP
experience to assist clients in reaching optimal outcomes for their
claim resolutions. Jennifer also develops the training content and
creates the educational programs at NuQuest.
Shymanski is the
co-chair of The National MSP Network’s Webinar Committee and a member of
the Communications Committee. She is also an instructor for the
Certified Medicare Secondary Payer (CMSP) and CMSP-Fellow designations.
And is an adjunct instructor of Business Law at Northcentral Technical
College in Wausau, Wisconsin.
Tom Spratt, CMSP Independent MSP Consultant After
a long career in Casualty insurance handling Workers' Compensation and
Liability matters, Tom Spratt has been actively involved in Medicare
Secondary Payer compliance since 1999 when he developed a
ground-breaking Medicare Secondary Payer compliance program for a
national carrier. He has spoken on this subject at national insurance
industry conferences as well as training sessions for clients.
He has a long record of active involvement in the insurance industry,
serving on committees for the Workers' Compensation Research
Institute/WCRI, the Property Casualty Insurers Association of
America/PCIAA and the Strategic Services on Unemployment and Workers'
Compensation/UWC. He also served on committees for the National
Structured Settlement Trade Association/NSSTA and the National Alliance
of Medicare Set-Aside Professionals/NAMSAP as well as the NAMSAP Board
of Directors.
He is on the faculty of the CMSP (Certified
Medicare Secondary Payer designation program), which is the only program
where both the law and allocations make up the curriculum.
He
currently is an Independent Consultant with a special focus on
Apportioned MSP Allocations in Liability matters in the settlement
process.
