Even though general liability bodily injury claims far outnumber workers’ compensation claims, the former has received less attention than workers’ compensation relative to Medicare Secondary Payer (MSP) compliance. However, plaintiffs, attorneys, and claims payers shouldn’t let their guard down simply because there is less policy guidance. The Department of Justice (DOJ) has increased its focus on unpaid Medicare conditional payments in recent years. Moreover, simply because the agency withdrew a proposed rule with respect to future medicals, it doesn’t mean that obligations, or exposure, do not exist with respect to post-settlement considerations.
