Despite being larger and more numerous, liability claims have always received less attention than worker’s compensation claims when it comes to Medicare secondary payer compliance. However, that status may be changing. The Department of Justice has increased its vigilance over unpaid conditional payment liens, claimant’s attorneys are facing more exposure when failing to satisfy client’s MSP obligations, and the specter of future medicals still looms large as Section 111 reporting becomes even more robust.
